Andrea Dewhurst is the Data Controller and therefore decides how your personal data is processed and for what purpose.

What is personal data?

Personal data relates to a living individual who can be identified from that data.  Special category data is a sub-category of personal data and includes data relating to health.

 

What and why I collect your personal data

1. I need to collect personal information about your health in order to provide you with the best possible treatment. Your requesting treatment and our agreement to provide that care constitutes a contract.  You can refuse to provide the information, but if you were to do so I would not be able to provide treatment.

2. I have a legitimate interest in collecting that information because without it I can't do my job effectively and safely.

3. I think it is important that I can contact you in order to confirm your appointments or to update you on matters relating to your medical care. This is in your legitimate interest.

4. Provided I have your consent, I may occasionally send you clinic updates. You may withdraw this consent at any time, just let me know by email: andrea.thechannelproject@gmail.com

 

How long do I keep your personal data?

I am legally required to keep client records for a minimum of seven years after your most recent appointment. In the case of minors, records must be kept until the patient reaches the age of twenty-five (seven years after reaching eighteen).  After this, you can ask me to delete your records, otherwise, I will retain your records indefinitely in order that we can provide you with the best possible care, should you need to see us at some future date.

Storing your information

Your records are stored according to the following methods:

• on paper, in locked filing cabinets;

• electronically (on ‘cloud’ servers), using a specialist medical-records service. This provider has given me its assurance that it is fully compliant with the General Data Protection Regulations. Access to this data is password-protected, and the passwords are changed regularly;

• on my office computer, which is password-protected, backed up regularly and kept in a safe place.

Sharing your information

Your data is strictly confidential.  I will never share your data with third parties without your consent. Only Andrea Dewhurst has routine access to your data to provide your treatment.

Only the following people/agencies will have routine access to your data:

• the medical-records service that stores and processes the files;

• an emailing marketing platform (e.g. Active Campaign), which I may use to coordinate email messages; your name and email address may be saved on its server.

In the eventuality that I (the practitioner) get symptoms of Covid-19 within 48 hours of having close contact with you during the appointment and then later test positive, I am obligated under law to provide your name, phone number or email and the date and time of your visit to the test and trace service. Please note that by attending the appointment you give consent for this.

Your rights

You have the right to see what personal data of yours I hold.  You can ask me to correct any factual errors. Provided the legal minimum period has elapsed, you can ask me to delete your records.

I want you to be absolutely confident that I am treating your personal data responsibly and that I am doing everything I can to make sure that only the people who can access that data have a genuine need to do so.

If you feel I have mishandled your personal data in some way, you have the right to complain.  Complaints should be sent to the Data Controller: Andrea Dewhurst
